HDC adopted new rules governing rural subdivision in 2010. We understand other Councils in the greater Waikato area are also considering raising their own subdivision rules governing the minimum area requirements for rural subdivision to the same minimum lot size. In the Matamata Piako District Council District Plan the minimum rural lot size is currently 8ha. If Council does decide to increase the minimum rural lot size they will also need to advertise the proposed change to ratepayers in an orderly, as proscribed by the RMA, manner. MPDC is currently in the process of amending its rules governing rural subdivision. They have consulted rate payers and other stake holders and are currently assessing any comments for inclusion in a planned change to its current rules. Watch this space for future updates. Many landowners in the district have already contacted us regarding the likely impacts on their properties and have instructed us accordingly.[Updated October 2011] However, any subdivision resource consent granted by any Council under its current rules will remain valid for a period of 5 years from the date of resource consent. If you are able to obtain a resource consent to subdivide your property under the current rules that consent cannot be changed by any subsequent changes to the District Plan in the next 5 years. You will be able to carry out your subdivision in an orderly manner provided you have a current resource consent in place. If you are considering a rural subdivision in the near future it would be in your best interests to act promptly to avoid the likelihood that the proposed, and any possible, changes to any Council's District Plan rules do not prevent you from carrying out your wishes.
